Terms of Service

These Terms of Service (“Terms”) govern your use of OnlyEstateSales (the “Service”), operated by KCSB Enterprises, Inc. (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service does

OnlyEstateSales aggregates publicly available estate sale, garage sale, and liquidation listings from third-party sources, removes duplicates, and organizes them into a driving route and an optional email digest for a city and date you choose. We are an information and organization tool. We do not host, run, sponsor, or endorse any sale, and we are not a party to any transaction between you and a seller.

2. Accuracy and third-party listings

Listing details — including addresses, dates, hours, and items — come from third parties and are provided on a best-effort basis. They may be incomplete, out of date, or wrong, and sales may be moved or cancelled without notice. Some addresses are not published until the morning of the sale. Always confirm a sale using the source link before you travel. We are not responsible for wasted trips, missed sales, or any decision you make based on the Service.

3. Accounts

You need an account to use most features, which we provide through our authentication partner. You are responsible for activity under your account and for keeping your login secure. You must provide accurate information and be at least 18 years old.

4. Subscriptions and billing

The Service offers a limited number of free generations, after which continued on-demand use and scheduled email digests require a paid subscription, billed at the price shown at checkout (currently $9 per month). Subscriptions are billed in advance through our payment processor, Stripe, and renew automatically each billing period until cancelled. You can cancel at any time from your account or by contacting us; cancellation stops future renewals, and your access continues through the end of the current paid period. Prices may change on prospective notice.

5. Acceptable use

The Service is for your personal use. You agree not to: resell, redistribute, or scrape data from the Service; use automated means to access it beyond normal personal use; attempt to disrupt or reverse-engineer it; or use it for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.

6. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings are accurate or complete, that any sale will occur as described, or that the Service will be uninterrupted or error-free.

7. Limitation of liability

To the fullest extent permitted by law, KCSB Enterprises, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or wasted time, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.

8. Refunds

Refunds are handled under our Refund Policy.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Service.

10. Changes

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Santa Barbara County, California.
